Tax advisory

Tax planning, opinions, representation before the tax authority and tax due diligence — so that you know the tax implications of a transaction before you decide.

Overview

Known tax risk, a well-founded decision

Tax legislation and the related rules change constantly, yet the decision-maker needs to know at the moment of the decision what tax burden and administrative obligations a transaction will bring.

Our advisers examine the ways a given transaction can be treated for tax purposes and which of them best fits the situation at hand. Corporate income tax, value added tax, personal income tax and other public charges are weighed together, because their effects are usually interconnected.

Misinterpreting the legislation is expensive after the event: a tax shortfall, a penalty and a long procedure can follow. It is therefore worth discussing the transaction before the contract is signed, and recording the recommended tax treatment in writing.

Frequently asked questions

Tax advisory — what is worth knowing

When should we turn to a tax adviser?

Preferably before the decision: when signing a contract, on a transformation, a property or share transaction, a transaction with a foreign partner, or when starting a new activity. We can help afterwards too, but by then the room for manoeuvre is narrower and putting things right usually costs more.

What does tax due diligence mean?

In a tax due diligence we review the company’s tax practice tax by tax and examine how well the solutions applied would stand up in a tax authority audit. We hand over the result in writing, identifying the risks found and the steps we recommend.

Will you represent us during a tax audit?

Yes. We support the procedure from preparing for the audit through compiling the documents to observations on the minutes, and we represent the company under a power of attorney. If an appeal is needed, we also help prepare the submissions.

What should we do if we have received a tax authority audit notice?

First let us review the audit mandate and the documents for the period under review together. We help compile the data requested, prepare your colleagues for the on-site discussions and, where necessary, draft observations or an appeal. Getting involved early usually improves the outcome considerably.

Can we get a written opinion on a specific tax question?

Yes. Once the facts are clear we give a written opinion supported by references to the legislation, which is also suitable for documenting the decision. This is particularly useful for larger transactions, transformations or international deals.
